These Terms of Service (“Terms”) govern your use of the Taximeter application and its related features (“the app”), provided by Sinan GUNES, operating as gunes.io (“we”, “us”, or “our”). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, stop using the app.
1. Overview
Taximeter provides tools for calculating fares from distance, time, and selected tariff settings. Features, including ride records and navigation where available, may vary by platform, device, and version. We provide software; we do not provide transportation services or set the agreement between a driver and a passenger.
2. Permission to use the app
We grant you a limited, non-exclusive, non-transferable licence to use the app for your personal use or lawful business activities, including taxi, rideshare, and fleet operations, subject to these Terms and applicable app-store rules. The app’s software, design, and branding remain ours or our licensors'.
You must not redistribute or sell the app itself, bypass its security measures, disrupt its services, or reverse engineer it except where applicable law permits. You must have legal capacity to accept these Terms or the permission of a parent or legal guardian where required.
3. Fare accuracy and local requirements
You are responsible for checking tariff settings and verifying fares before charging a passenger. GPS reception, device sensors, permissions, battery settings, interruptions, and incorrect rate settings can affect distance, time, and fare calculations. Built-in tariffs may be incomplete or out of date. Check applicable rates, surcharges, minimum fares, currency, and measurement units before each use.
The app does not by itself establish compliance with taxi licensing, metrology, fare-display, receipt, tax, or other local requirements. These Terms do not represent that the app is a certified or legally approved taximeter. Where an approved or calibrated meter is required, use equipment that meets those requirements. You remain responsible for your licences, lawful charges, passenger disclosures, and any required records.
4. Safe driving and navigation
Set up the app and review or change settings while safely parked. Do not interact with it in a way that distracts you from driving. Follow traffic laws, road signs, actual road conditions, and vehicle-manufacturer instructions at all times.
Where navigation is available, routes and guidance may be inaccurate, incomplete, or unavailable. Use your judgement and never follow directions that are unsafe or unlawful. The app is not an emergency service.
5. Devices, permissions, and records
You are responsible for using a compatible device and granting the permissions needed for the features you choose. Some features may need an internet connection; your carrier’s charges may apply. Restricted location access, loss of power, or operating-system limitations may interrupt metering or other features.
Keep separate copies of any ride records you need for your business or legal obligations. Do not rely on the app as your only recordkeeping system.
6. Privacy
Our Privacy Notice explains how we process personal information and the choices available to you. These Terms do not replace that notice or constitute consent to processing where separate consent is required. If you use the app in your business, you are responsible for any passenger notices or permissions required for your own handling of personal information.
7. Third-party services and purchases
App stores, operating systems, maps, and other third-party services may have their own terms and availability limits. Their services may change or stop working independently of the app.
If you choose a paid feature offered through an app store, the price and applicable payment terms will be shown before purchase. Billing, cancellation, and refund requests are handled under the relevant store’s rules and applicable law. Nothing in these Terms removes a statutory refund or other consumer right.
8. Availability and warranties
We aim to provide a useful and reliable app, but cannot promise uninterrupted operation, compatibility with every device, or error-free calculations and navigation. To the extent permitted by law, the app is provided “as is” and “as available” without additional warranties. Any warranties, quality standards, or remedies that cannot legally be excluded still apply.
9. Responsibility for loss
To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the app, including lost business opportunities, or for losses caused by incorrect settings, misuse, or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer rights remain unaffected.
10. Updates and ending use
You may stop using and uninstall the app at any time. We may update features to maintain compatibility, improve security, or meet legal requirements. We may restrict use that materially breaches these Terms or threatens the security of the app. Where reasonably possible, we will give notice and an opportunity to resolve the issue before restricting access.
If we discontinue the app or materially reduce a paid service, we will provide reasonable notice where practicable and honour any remedies required by law. Uninstalling the app does not itself cancel any subscription you may have purchased through an app store.
11. Changes to these Terms
We may revise these Terms to reflect changes to the app, legal requirements, or our operations. We will publish the revised Terms here with an updated date and provide reasonable advance notice of material changes where required. Changes will apply prospectively. Where the law requires your agreement, we will seek it before applying those changes. If you do not accept revised Terms, you may stop using the app without losing any rights already accrued.
12. Governing law
These Terms are governed by the laws of the Republic of Türkiye, subject to any mandatory protections available under the laws of your country of residence. They do not restrict your right to bring a claim in a court available to you under applicable consumer law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
